Confidence in the market is gradually returning but perhaps it is no longer the broad-brush optimism of previous cycles – that shift is reshaping how value is assessed, created and captured. The market seems to be more discerning, more data‑driven, and more focused on long‑term resilience. The legal frameworks underpinning deals, development, financing, and ESG compliance are becoming more complex with impending legislation due to create significant structural change on many fronts, introducing additional risks but also opportunities.

A disciplined optimism 

Capital is re‑engaging, but with heightened scrutiny. Investors, lenders, and developers are demanding greater clarity on risk allocation, regulatory exposure and future‑proofing.

We are seeing:

  • more rigorous due diligence
  • tighter covenant packages
  • increased focus on ESG strategy and sustainability
  • more structured joint ventures and partnerships
  • building safety, energy performance and wider regulatory compliance increasingly affect pricing, liquidity and transaction risk

Delivery, Governance and Risk Management Matter More Than Ever

Confidence is returning, but the market is more selective, more regulated, and more complex. Success in 2026 will depend on:

  • clarity of strategy
  • quality of assets – avoiding stranded or discounted assets
  • strength of partnerships and
  • the ability to navigate a rapidly evolving legal and regulatory landscape
